Terms of Service

1. Overview and Acceptance

By signing up for and using Telo's lead generation service (the "Service"), you ("Client," "you," or "your") agree to these Terms and Conditions (this "Agreement") with TELO TECHNOLOGIES, which does business publicly as Telo ("Telo," "we," "us," or "our"). Please read this Agreement carefully. By checking the acceptance box, submitting payment, or otherwise using the Service, you confirm that you have read, understood, and agreed to be legally bound by this Agreement.

This Agreement constitutes a binding electronic contract under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA). Your electronic acceptance has the same legal effect as a handwritten signature.

If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to this Agreement.

2. Service Description

Telo provides real estate leads to Clients, who receive leads in their chosen area(s) based on their specified campaign and monthly capacity. Telo does not guarantee any specific conversion rate, transaction outcome, or revenue result.

3. Fees, Payment, and Billing Authorization

3.1 Lead Fee

The fee is $90 USD per lead delivered to the Client.

3.2 Initial Prepayment

Client must pre-pay $90 for their first lead at sign-up.

3.3 Recurring Per-Lead Charges

Client expressly authorizes Telo to charge the payment method on file $90 USD for each lead delivered, immediately upon delivery, with no further notice or authorization required for each individual charge. Client acknowledges and agrees that:

  • (a) Multiple $90 charges may occur on the same day, week, or month, depending on lead volume and the monthly capacity Client has selected;
  • (b) Each such charge is a pre-authorized transaction under this Agreement;
  • (c) Charges will continue at this rate and frequency until Client cancels the Service in accordance with Section 6;
  • (d) Client is solely responsible for maintaining sufficient funds and a valid payment method.

3.4 Statement Descriptor

Charges will appear on Client's bank or credit card statement as "TELO" or a similar identifier containing the Telo name. Client agrees to recognize charges bearing this descriptor as authorized charges under this Agreement.

3.5 Itemized Lead Delivery

Telo will email an itemized lead delivery to Client's email address on file for every charge, identifying the lead delivered, and the timestamp of delivery. Client is responsible for maintaining a valid email address on file and reviewing receipts promptly.

3.6 Payment Failure

If a payment fails, lead delivery will be paused until payment is completed. Client remains responsible for all fees accrued prior to the pause. Telo reserves the right to suspend or terminate Service for repeated payment failures.

3.7 Taxes

Client is responsible for any applicable sales, use, or other taxes associated with the Service.

4. Lead Delivery, Capacity, and Definition of Delivery

4.1 Definition of Delivered Lead

For purposes of this Agreement, a lead is considered "delivered" at the moment Telo transmits the lead's contact information to Client by any of the following means: email to Client's email address on file, SMS to Client's phone number on file, notification within Client's Telo dashboard, or CRM/webhook integration designated by Client. Receipt by Client is presumed upon transmission. Billing occurs upon delivery as defined herein, regardless of whether Client opens, views, or acts upon the lead.

4.2 Monthly Capacity

Client sets a desired monthly lead capacity at sign-up and may adjust it at any time with at least 48 hours' written notice (via email or SMS).

4.3 Results Focused Period

Client expressly agrees that their first full month of Service will run uninterrupted to ensure sufficient lead volume for measurable results. Client acknowledges this commitment at signup as a material term of this Agreement.

4.4 Geographic Assignment

Leads are delivered to Client based on the area(s) Client selects, designated by ZIP code or county.

5. Momentum Protection Policy

To ensure Clients achieve consistent results, all campaigns must remain active for a minimum of 30 consecutive days following launch and following re-activation after any pause period. Pausing a campaign is permitted, but pauses are limited to a maximum of 21 consecutive days. Time spent paused does not count toward eligibility for loyalty bonuses or the Telo Promise.

Client expressly acknowledges and agrees to this policy at signup as a material term of this Agreement, and acknowledges that this policy is intended to protect pipeline momentum and the Client's ability to reach conversion benchmarks necessary for ROI.

6. Term, Cancellation, and Refunds

6.1 Term

This Agreement is month-to-month and continues until cancelled by either party in accordance with this Section.

6.2 Cancellation Notice

Client must provide written cancellation notice (by email to getsupport@teloai.ai or via the dashboard cancellation function) at least 48 hours before the desired cancellation effective time. Leads delivered prior to the effective cancellation time remain billable.

6.3 Refund Policy

All fees paid are non-refundable except in the following limited circumstances:

  • (a) Duplicate charges caused by Telo system error;
  • (b) Charges processed after a valid cancellation became effective under Section 6.2;
  • (c) Leads that qualify for replacement or credit under Section 7 (Lead Replacement Policy), where Telo, in its review, determines that a monetary refund is the appropriate remedy in lieu of replacement.

6.4 Waiver of Replacement Right Upon Chargeback

If Client initiates a chargeback or payment dispute with their card issuer for any charge that would otherwise qualify for replacement or credit under Section 7, Client thereby waives any right to replacement, credit, or refund for that charge under this Agreement.

7. Lead Quality and Disputes

7.1 No Outcome Guarantee

Telo strives to deliver high-quality, verified leads but does not guarantee any specific conversion, listing, transaction, or revenue outcome.

7.2 Lead Replacement Policy

Telo will provide a replacement lead or account credit for any lead that meets all of the following criteria:

  • (a) Reported to Telo within seven (7) business days of delivery;
  • (b) Submitted via SMS or by email to their dedicated account manager, or via email to getsupport@teloai.ai, with the lead reference and reason for the request; and
  • (c) Falls into one of the following categories:
    • (i) Invalid contact details — both the phone number and email address provided are non-working, disconnected, or undeliverable;
    • (ii) Wrong party — the contact is not the homeowner or decision-maker for the property;
    • (iii) Already represented — the contact was already under contract with another Realtor at the time of delivery;
    • (iv) Outside service area — the property is outside Client's specified target ZIP codes or counties.

7.3 Required Documentation

Client must provide reasonable supporting documentation to substantiate a replacement claim, which may include: screenshots of disconnected-number messages, dated communications with the lead, MLS or public-record evidence of existing representation, or property-address confirmation. Replacement decisions are made based on the documentation submitted and the criteria in Section 7.2.

7.4 Response Timeline

Telo will acknowledge replacement requests within one (1) business day and issue a decision within five (5) business days of receiving complete documentation.

7.5 Out-of-Category Complaints

Complaints that fall outside the categories listed in Section 7.2 (for example, subjective lead quality concerns) do not qualify for automatic replacement, but Client may still submit them to getsupport@teloai.ai. Telo reviews such complaints on a case-by-case basis and may, at its discretion, offer a goodwill credit or replacement.

8. Pre-Dispute Resolution Requirement

8.1 Mandatory Pre-Dispute Contact

Before initiating any chargeback, payment dispute, or reversal with their card issuer or bank for any charge under this Agreement, Client agrees to first contact Telo at getsupport@teloai.ai to attempt resolution.

8.2 Telo's Response Commitment

Telo commits to:

  • (a) Acknowledging billing complaints within one (1) business day of receipt;
  • (b) Investigating and issuing a resolution decision within five (5) business days; and
  • (c) Where the complaint is valid, processing refunds, credits, or replacements promptly.

8.3 Effect of Failure to Follow This Process

Initiating a chargeback or payment dispute without first contacting Telo and allowing the response window in Section 8.2 to elapse constitutes a material breach of this Agreement. In addition to other remedies available, Telo may: suspend or terminate Service; recover from Client all chargeback fees, processing fees, and reasonable costs (including attorneys' fees) incurred in responding to the dispute; and report the breach to relevant credit and merchant-risk databases.

8.4 No Waiver of Rights

Nothing in this Section limits any rights Client has under applicable law that cannot be waived by contract.

9. The Telo Promise (Guarantee)

9.1 Guarantee

If Client does not list at least one (1) property within the first six (6) months of active Service, Telo will continue delivering leads at no additional cost until Client lists at least one property, subject to the conditions below.

9.2 Eligibility Conditions

To qualify for this Guarantee, Client must:

  • (a) Call each delivered lead at least seven (7) times by phone, with call attempts logged via screenshot with date and time clearly visible;
  • (b) Maintain documented proof of all call attempts;
  • (c) Attend every scheduled coaching, onboarding, and check-in call with Telo;
  • (d) Remain an active, paying subscriber for the full six (6) month period without unpaid pauses or interruptions; and
  • (e) Be in good standing under this Agreement.

9.3 Verification

Telo reserves the right to verify compliance with these conditions before applying the Guarantee. Failure to meet any of these conditions voids eligibility.

9.4 Acknowledgment

Client expressly acknowledges these conditions at signup and agrees that they are material to the availability of the Guarantee.

10. Loyalty Bonuses

To reward long-term Clients, Telo provides bonus leads at the following milestones of uninterrupted, paid active subscription:

  • 3 months: 3 bonus leads
  • 6 months: 4 bonus leads
  • 12 months: 5 bonus leads

Loyalty bonuses are available only to Clients who maintain uninterrupted, paid Service for the specified duration. Time spent paused, in arrears, or under unresolved dispute does not count toward milestones.

11. Client Responsibilities

Client agrees to:

  • (a) Proactively contact and follow up with all leads in a timely manner;
  • (b) Attend all scheduled coaching and success calls with Telo;
  • (c) Use leads solely for Client's real estate business and not resell, redistribute, share, or otherwise misuse lead data;
  • (d) Comply with all applicable laws, including the TCPA, CAN-SPAM, state Do-Not-Call rules, and Fair Housing laws when contacting leads;
  • (e) Maintain accurate and updated contact and payment information; and
  • (f) Promptly review receipts, and report any concerns within the timeframes set forth in this Agreement.

12. Telo SMS Messaging Program

12.1 Consent

Telo sends text messages only to individuals who have provided explicit consent to receive them.

12.2 Message Frequency and Charges

Message frequency varies by your interaction with Telo. Message and data rates may apply.

12.3 Managing Messages and Support

Reply HELP for help, STOP to cancel, or START to resume messages. For support, email getsupport@teloai.ai.

12.4 No Purchase Condition

Your consent to receive text messages is not a condition of purchase.

13. Limitation of Liability

To the maximum extent permitted by law, Telo's total cumulative liability arising out of or relating to this Agreement or the Service will not exceed the total fees paid by Client in the thirty (30) days preceding the event giving rise to the claim.

Telo will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, or lost business opportunity, even if advised of the possibility of such damages.

Telo is not responsible for issues outside its direct control, including but not limited to non-response from leads, market conditions, Client's sales performance, third-party platform outages, or actions of leads or other third parties.

14. Force Majeure

Neither party will be liable for failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications outages, third-party service failures, pandemics, or epidemics.

15. Modifications

Telo may update this Agreement from time to time. Telo will notify Client of material changes by email or dashboard notice at least fourteen (14) days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Agreement. If Client does not agree to the updated terms, Client's sole remedy is to cancel the Service in accordance with Section 6.

16. Assignment

Client may not assign or transfer this Agreement without Telo's prior written consent. Telo may assign this Agreement in connection with a merger, acquisition, sale of assets, or by operation of law.

17. Severability

If any provision of this Agreement is held to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving the parties' original intent.

18. Entire Agreement

This Agreement, together with any documents expressly incorporated by reference (including Telo's Privacy Policy), constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements, representations, or understandings — whether oral or written — including any statements made by sales representatives or in marketing materials. No representation, promise, or inducement not contained in this Agreement is binding.

19. Waiver

No failure or delay by either party in exercising any right under this Agreement constitutes a waiver of that right. A waiver is effective only if in writing and signed by the waiving party.

20. Notices

Notices to Telo must be sent to getsupport@teloai.ai. Notices to Client may be sent to the email address on file, and are deemed received upon transmission.

21. Acceptance

By checking the acceptance box and submitting payment, Client confirms that Client has read, understood, and agreed to this Agreement, including specifically:

  • The per-lead recurring billing authorization in Section 3;
  • The Momentum Protection Policy in Section 5;
  • The Refund Policy in Section 6;
  • The Pre-Dispute Resolution Requirement in Section 8; and
  • The conditions of the Telo Promise in Section 9.
